Strike Terms and Conditions

Effective Date: February 2, 2023

MOBILESTYLES App ("us", "we", or "our") operates the website and the MOBILESTYLES mobile application (the "Service").

This page informs you of our policies regarding the application, consequences, and forgiveness of Strikes on the MOBILESTYLES App.

Unless otherwise defined in this Strike Policy, terms used in this Strike Policy have the same meanings as in our Terms and Conditions.

Strikes

Strikes are consequences MOBILESTYLES manually gives to users for certain actions. Strikes will appear on the user’s profile and directly affect the rating of their client or professional account, visible to other users when requesting or providing services. Strikes can be appealed by users, and reviewed by MOBILESTYLES to determined the validity of it and if there are grounds for removal or forgiveness, in which case will remain on their profile as such.

Strike Consequences

Consequences are evaluated and manually applied immediately after a strike is issued by MOBILESTYLES. Consequences include but are not limited to:

Charges. A charge may be issued along with a strike. If client, default payment method will be charged. If professional, bank account will be charged.

Blockage. A user’s account may be blocked as the result of a strike.

Deactivation. A user’s account may be deactivated as the result of a strike.

Downgrading. A professional’s account may be downgraded as the result of a strike.

Assigned to Appointment. A strike may be issued in connection to a specific appointment or not.

Compensation. If a strike is issued in connection to a specific appointment, the opposite party of the appointment may be compensated.

Strike Forgiveness

Some strikes may be appealed and may be eligible for forgiveness on a case-by-case basis by contacting MOBILESTYLES at (cs@mobilestyles.com).

Account Statuses

Blocked

If a user’s account is blocked, the user will be able to login but will be restricted from certain features, such as:

Clients:

Sending appointment requests

Accessing timeline

Receiving referral benefits (referral code will be invalid)

Applying to become a professional

Professionals:

Sending appointment requests

Receiving appointment requests

Appearing in professional search

Accessing personal professional page

Accessing personal promo code

Accessing timeline

Receiving referral benefits (referral code will be invalid)

Requesting additional state to service

User must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

Downgraded

If a professional’s account is downgraded, professional will be able to login but will be restricted from all professional features and certain other features, such as:

Applying to become a professional

Sending appointment requests

Receiving appointment requests

Appearing in professional search

User must submit a new professional application if they wish to have their account upgraded back to professional status.

Deactivated

If a user’s account is deactivated, the user will be unable to login or receive marketing communications from MOBILESTYLES. User must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to re-activate account.

Strike Types

Appointment Expiration

An appointment is expired when a request has not been answered within 30 minutes of the expected start time of the appointment.

Clients:

Client shall not be penalized for appointment expiration.

Professionals:

Upon first instance, if professional does not accept or decline any client’s request, professional will receive 1 Strike, and professional account will be blocked. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

ASAP Appointment Expiration

An ASAP appointment is expired when a request has not been answered within 30 minutes of the expected start time of the ASAP appointment.

Clients:

Client shall not be penalized for ASAP appointment expiration.

Professionals:

Upon first instance, if professional does not accept or decline any client’s ASAP request, professional will receive 1 Strike, will be charged 27% of subtotal of services to have been performed, and professional account will be blocked. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

ASAP Appointment Decline

An ASAP appointment is declined when the professional is unable to accept the client’s pending ASAP booking request.

Clients:

Client shall not be penalized for ASAP appointment declines.

Professionals:

Upon first instance, if professional declines any booked ASAP appointment, no penalty shall be incurred.

Upon second instance, if professional declines any booked ASAP appointment, professional will receive 1 Strike.

Upon third instance, if professional declines any booked ASAP appointment, professional will be charged 27% of subtotal of services to have been performed, 1 Strike, and professional account will be blocked. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

Appointment Cancel (within more than 24 hours)

An appointment is canceled when the user is no longer able to perform or receive the service(s) and the appointment will not take place.

Clients:

Client shall not be penalized for appointment cancellation (within more than 24 hours).

Professionals:

Upon first instance, if professional cancels any booked appointment with more than 24 hours notice, professional will receive 1 Strike, and professional account will be blocked. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

Upon second instance, if professional cancels any booked appointment with more than 24 hours notice, professional will receive 2nd Strike, a charge of $40 or 75% of subtotal of services to have been performed (whichever is greater), and professional account will be blocked. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

Upon third instance, if professional cancels any booked appointment with more than 24 hours notice, professional will receive 3rd Strike, and professional account will be deactivated. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to re-activate account.

Appointment Cancel (within less than 24 hours)

An appointment is canceled when the user is no longer able to perform or receive the service(s) and the appointment will not take place.

Clients:

Upon first instance, if client cancels any booked appointment with less than 24 hours notice, client will receive a charge of $50 or 50% of subtotal of services to have been performed (whichever is greater). If client cancels with less than 2 hours before the start of the appointment, client will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater). Professional will receive 40% of client fee total.

Professionals:

Upon first instance, if professional cancels any booked appointment with less than 24 hours notice, professional will receive 3 Strikes, a charge $50 or 50% of subtotal of services to have been performed (whichever is greater), and professional account will be blocked. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account. If professional cancels with less than 2 hours before the start of the appointment, professional will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater).

ASAP Appointment Cancel

An ASAP appointment is canceled when the user is no longer able to perform or receive the service(s) and the ASAP appointment will not take place.

Clients:

Upon first instance, if client cancels any booked ASAP appointment, client will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater).

Upon second instance, if client cancels any booked ASAP appointment, client will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater), and client account will be deactivated. Client must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to re-activate account.

Professionals:

Upon first instance, if professional cancels any booked ASAP appointment, professional will receive 3 Strikes, a charge $50 or 50% of subtotal of services to have been performed (whichever is greater).

Upon second instance, if professional cancels any booked ASAP appointment, professional will receive 3 Strikes, a charge $50 or 50% of subtotal of services to have been performed (whichever is greater), and professional account will be deactivated. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to re-activate account.

Appointment No Show

An appointment is considered “No Show” when the user does not keep nor cancel the appointment.

Clients:

Upon first instance, if client is a “No Show” for any booked appointment, client will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater), and client account will be blocked. Professional will receive 40% of client fee total. Client must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

Professionals:

Upon first instance, if professional is a “No Show” for any booked appointment, professional will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater), and professional account will be deactivated. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to re-activate account.

ASAP Appointment No Show

An ASAP appointment is considered “No Show” when the user does not keep nor cancel the ASAP appointment.

Clients:

Upon first instance, if client is a “No Show” for any booked ASAP appointment, client will receive a charge of $50 or 100% of subtotal of services to have been performed (whichever is greater), and client account will be blocked. Professional will receive 40% of client fee total. Client must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to unblock account.

Professionals:

Upon first instance, if professional is a “No Show” for any booked ASAP appointment, professional will receive a charge of $60 or 100% of subtotal of services to have been performed (whichever is greater), and professional account will be deactivated. Professional must contact MOBILESTYLES at (cs@mobilestyles.com) to have account reviewed if they wish to re-activate account.

Appointment Delay

An appointment is delayed when one of the users are running late and have used the delay feature through the MOBILESTYLES application, indicating that they need another 15 minutes to arrive to the location; or if the appointment has not been started by the expected start time.

Clients:

If client delays any booked appointment for 15 minutes, client will be charged $10. For each additional 15 minutes, client will be charged additional $10. Professional will receive 100% of client late fee total.

Professionals:

If professional delays any booked appointment for 15 minutes, professional will be charged $10 or 10% of subtotal of services to be performed (whichever is greater). After 30 minutes, the appointment will be considered a “No Show”, overriding the delayed fee, and “No Show” fees will be applied.

ASAP Appointment Delay

An ASAP appointment is delayed when one of the users are running late and have used the delay feature through the MOBILESTYLES application, indicating that they need another 15 minutes to arrive to the location; or if the ASAP appointment has not been started by the expected start time.

Clients:

If client delays any booked ASAP appointment for 10 minutes, client will be charged $10. For each additional 10 minutes, client will be charged an additional $10. Professional will receive 100% of client late fee total.

Professionals:

If professional delays any booked ASAP appointment for more than 10 minutes, professional will be charged $20 or 20% of subtotal of services to be performed (whichever is greater). For each additional 15 minutes, professional will be charged an additional $10. After 20 minutes, the appointment will be considered a “No Show”, overriding the delayed fees, and “No Show” fees will be applied.

Custom

Custom strikes will be issued only via MOBILESTYLES to resolve LIVE appointment complications. The strikes and consequences are assigned based on the presented case.
